Hugging Face permits repositories that generate explicit, consensual adult content, provided they’re properly labeled or gated—but any model that can produce bestiality (sexual content with animals) is disallowed, because:
Illegal or unlawful content
The policy forbids “All Content that violates any applicable law or regulation.” Bestiality is illegal in virtually every jurisdiction.
Sex without explicit consent
It also bans “Sexual Content … created without explicit consent” — and animals cannot give legal, informed consent.
Bottom line:
Adult-only, consensual erotic models are allowed if you tag them “Not For All Audiences” or gate them.
Any model whose outputs include bestiality is in breach of Hugging Face’s Content Policy and therefore cannot be hosted on the Hub.

As far as the U.S. is concerned the act is illegal in pretty much every state but in many states it is made illegal under cruelty to animals and not because it is patently offensive. This being the case, in those states it does not meet the criteria under the Miller Test (https://en.wikipedia.org/wiki/Miller_test) that would make images of the act illegal. Add to this that images created by generative AI do not depict a real animal and therefore cannot be considered cruelty to the animal.
Based on this, the first part of your claim, for many jurisdictions, does not hold water. The second is questionable as well. I'm assuming that rule is mainly applicable to Loras/fine tunes/etc that depict a real person and would be quite difficult to apply it to animals as you would be hard pressed to show me the animal used in the training, if it exists even, to prove it is even real.
This is why you can easily find beastiality/zoophilia porn on the web.
