License Compatibility

Hi , I’d like to report a potential license incompatibility in
Yntec/RainbowRainbow. From the model card and information available, it looks like this model is a merged model, built from three base models — one of which is
Yntec/RainbowPunk, which is licensed under CC-BY-NC-ND 4.0.

However, RainbowRainbow is currently released under the CreativeML OpenRAIL-M license, which may not be legally compatible with the strict terms of CC-BY-NC-ND 4.0.

⚠️ License Conflicts:

CC-BY-NC-ND 4.0 (RainbowPunk):
• Non-Commercial (NC): Forbids any commercial use
• No Derivatives (ND): Forbids distribution of modified or adapted versions
• Requires attribution

CreativeML OpenRAIL-M (RainbowRainbow):
• Permits modification and redistribution
• Allows certain commercial uses (unless further restricted)
• Meant for open, adaptable downstream usage

Conflict:
→ CC-BY-NC-ND does not permit derivative works, including merges
→ Publishing a merged model under OpenRAIL-M introduces rights that the original license explicitly denies
→ This potentially violates the license of RainbowPunk and puts downstream users at risk of non-compliance

🔹 Suggestions for Resolving

1. Clarify in the model card that one of the base models (RainbowPunk) is licensed under CC-BY-NC-ND 4.0
2. Reconsider whether the merged model can legally be published under CreativeML OpenRAIL-M at all
   • If not, you may need to remove the RainbowPunk component
   • Or adjust the license to reflect the most restrictive license (i.e., CC-BY-NC-ND)
3. Include a clear statement about usage limitations — especially that derivative and commercial use may be prohibited
4. If in doubt, consider consulting with the original model authors or legal counsel
