License Incompatibility
Hi, I’d like to report a potential license conflict in cagliostrolab/animagine-xl-3.0-base
. This model appears to be fine-tuned fromLinaqruf/animagine-xl-2.0
, which is governed by the OpenRAIL++ license.
However, the downstream model is currently distributed under the Fair AI Public License 1.0-SD, which appears to conflict with key conditions imposed by the OpenRAIL++ license — especially with respect to license retention, redistribution requirements, and the use of non-free terms.
⚠️ Key violations of the OpenRAIL++ License:
Clause – Attribution & License Preservation:
• You must include a copy of the original OpenRAIL++ license
• You must retain attribution and copyright notices
• You cannot relicense the model under a conflicting or more restrictive license
Clause – Permitted Use:
• Use and distribution must comply with OpenRAIL++’s Acceptable Use Policy
• You cannot add usage restrictions that contradict or override this policy
Clause – Commercial Use:
• OpenRAIL++ permits commercial use subject to acceptable use policy
• Fair AI Public License 1.0-SD adds additional registration steps and network-access constraints that are not part of the upstream license
Incompatible Terms in the Fair AI Public License 1.0-SD:
• Prohibits model use in law enforcement, immigration, medical applications, etc.
• Requires licensee to serve model source code via network interactions
• Introduces separate governance via the Freedom of Development Project
• Adds moral and geopolitical limitations (e.g. “no social harm”, “no national unity harm”)
• Not an OSI-approved open-source license
suggestion:
1. Restore the OpenRAIL++ license as the primary license in the model card and distribution files
2. Include this NOTICE in the repository or model card:
> "This model is based on a derivative of animagine-xl-2.0 and is distributed under the OpenRAIL++ license. Copyright © Original Contributors."
3. Remove or clearly isolate any new restrictions introduced by the Fair AI Public License 1.0-SD
4. Ensure that redistribution, commercial use, and downstream derivatives remain compliant with the OpenRAIL++ Share-Alike clause
