If this is based on Flux 1 Dev, is the MIT license legal? Should it be using FLUX.1 [dev] Non-Commercial License instead?

I think Flux 1 Dev license prevents redistribution of derivative work with a more permissive license than the original Flux license: https://huggingface.co/black-forest-labs/FLUX.1-dev/blob/main/LICENSE.md
